These Terms and Conditions ("Terms") govern your access to and use of the DeskDash website at https://www.desktop-dashboard.com, the DeskDash desktop application, and the DeskDash widget marketplace (together, the "Service"), operated by Nair Development Hub SRL ("DeskDash", "we", "us", or "our").
By visiting the website, creating an account, purchasing a licence, installing the application, or submitting a widget, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
- Company: Nair Development Hub SRL
- Registered address: Str. Tineretului 63, Chiajna, Ilfov County, Romania
- Company registration number / CUI: 48366031
- Contact: contact@desktop-dashboard.com
2. What DeskDash is
DeskDash is a Windows desktop application that displays live, interactive widgets on your desktop background. You arrange, resize and restyle widgets, install additional widgets from a built-in marketplace, or write your own using plain HTML, CSS and JavaScript.
Widgets run in a sandbox. Each widget declares the capabilities it needs (for example, network access to named hosts, or reading a file you have chosen), and you approve or withhold those capabilities when you install it. Section 12 explains what this does and does not mean.
We may add, change, or remove features over time.
3. Scope of these Terms and related documents
These Terms cover your relationship with us: your account, your purchase, your use of the marketplace, and your submissions if you publish widgets.
Two further documents apply alongside these Terms and are incorporated by reference:
- The End User Licence Agreement ("EULA"), which governs your licence to install and use the DeskDash software itself.
- The Privacy Policy, which explains what personal data we process and why.
If these Terms and the EULA conflict on a question about the software licence, the EULA prevails.
4. Eligibility
- You must be at least 16 years old to purchase a licence or create an account. If you are under 16, do not use the Service.
- You must be able to enter into a binding contract.
- You are responsible for all activity that occurs under your account.
5. Accounts and login
- An account is created when you purchase DeskDash. Accounts are identified by email address only. There are no passwords: you sign in by entering a six digit code we email to you.
- You are responsible for keeping access to your email address secure. Anyone who can read your email can sign in to your account.
- Login is available to accounts with a completed purchase.
- If you publish widgets, you also choose a publisher handle. Handles are public and permanent: they appear in the identifier of every widget you publish and cannot be changed or reused. See Section 11.
5.1 Deleting your account
You may delete your account at any time from your account settings, or by emailing contact@desktop-dashboard.com.
Deleting your account is permanent, cannot be undone, and ends your licence. Because your licence exists only as a record attached to your account, deleting the account destroys it. When you delete your account:
- your licence key is revoked and cannot be restored or reissued;
- you can no longer sign in, generate a new key, download the installer, or install or update widgets from the marketplace;
- a copy of DeskDash already installed on your device continues to run, but loses marketplace access once its licence check lapses;
- you are not entitled to a refund, and regaining access requires purchasing a new licence.
Widgets you have published remain in the marketplace under Section 11.7. We may retain a minimal record of your purchase where we are legally required to do so, for example for tax and accounting purposes, as described in our Privacy Policy.
Please make sure you understand this before deleting. If you only want to stop using DeskDash, uninstalling the application is enough; you do not need to delete your account.
6. Purchase, price and payment
- DeskDash is sold as a one time purchase. There is no subscription and no recurring charge for the application.
- Prices are shown on our website. Applicable taxes are calculated and displayed at checkout.
- Payments are processed by Stripe. Where Stripe acts as merchant of record for your transaction, Stripe is the seller of record for that payment, handles applicable sales taxes and VAT, and its own terms apply to the payment itself. We never receive or store your card details.
- Your licence is delivered by email as a licence key, to the address you provide at checkout. Please make sure it is correct. If your key does not arrive, contact contact@desktop-dashboard.com.
- We may change our prices at any time. A price change never affects a purchase you have already completed.
- We may correct errors, inaccuracies or omissions in pricing or product descriptions at any time without prior notice, including after an order has been submitted where it was affected by an obvious error, and we may cancel or decline an order on that basis.
7. Licence keys, activation and devices
Your purchase entitles you to a personal licence, granted on the terms of the EULA. The following operational rules apply:
- One active key per account. Your account holds one active licence key at a time.
- One device per key. The first device that successfully activates a key is bound to it. Attempting to activate the same key on a second device is refused.
- Moving to another device. Generate a new key from your account settings. Doing so revokes your previous key, which frees the licence for the new device. This is the supported transfer path and you may use it as often as you reasonably need to.
- Revalidation. The application checks the validity of your key periodically. These checks are built with tolerance for temporary network or server failures, so that a problem on our side or a brief outage on yours does not interrupt legitimate use.
- That tolerance is not a licence. A valid licence is required to use DeskDash. If your key is revoked or expires, if you delete your account, or if you obtain a refund, your right to use the application ends and you must stop using it. Any continued operation of an installed copy after that point does not extend your rights.
- We may change this. We may change how and how often validation happens, shorten or remove any tolerance period, and change what a licence problem restricts, up to and including access to the application as a whole. We may do so at any time, in particular to address abuse.
- Licence keys are personal. You may not sell, share, sublicense or publish your key, except where mandatory law provides otherwise.
- Keys are stored by us as a hash only. We cannot recover a lost key: generate a new one from your account settings.
8. Refunds and right of withdrawal
Statutory withdrawal right. If you are a consumer in the EU, you normally have 14 days to withdraw from a distance purchase. For digital content supplied immediately, this right ends once supply begins, provided you have given express consent and acknowledged the consequence. At checkout you request immediate supply of the licence and acknowledge that you lose the right of withdrawal once the licence key is issued to you.
Our refund practice. Regardless of the above, we want people to be happy with what they bought:
- Refunds are handled case by case at our discretion and are not self serve. To request one, email contact@desktop-dashboard.com with the email address you purchased with.
- We will generally grant a refund requested within 14 days of purchase where the application does not work for you or is not what you expected.
- We may decline a refund in cases of abuse, including repeat purchase-and-refund cycles or requests made after extended use.
- Once that period has passed, dissatisfaction with a later change to the application is not by itself grounds for a refund. DeskDash is actively developed and will change over time. See Section 9.1.
- Where Stripe is the merchant of record for your transaction, the refund is processed through Stripe.
Nothing in this section limits any mandatory refund, guarantee, or consumer right you have under Romanian or EU law. See Section 18.
9. Early access
DeskDash is offered as an early access release. This means:
- Features may change, be added, or be removed.
- You may encounter defects, incomplete functionality, or interruptions.
- Documentation, tooling and the widget catalogue are still growing.
Statements about future plans, whether on our website, in our FAQ, in release notes, or in public posts, including plans for other operating systems, additional platforms, pricing intentions or planned features, are statements of intent and not contractual commitments. Do not purchase on the basis of functionality that does not exist yet.
9.1 Changes to the application
We may modify DeskDash over time, including by adding, changing, removing or discontinuing features. We do this for reasons including keeping the application secure, adapting it to changes in Windows or in third party services it relies on, correcting defects, and improving the product.
Where a change would materially and negatively affect your ability to use DeskDash, we will give you reasonable advance notice by email or in the application, and, where applicable law gives you a right to terminate on that basis, we will explain how to exercise it.
Outside those cases, continued development is part of what DeskDash is, and a change you dislike is not by itself a defect or a ground for a refund once the period in Section 8 has passed.
10. The marketplace: installing widgets
- Browsing the marketplace is open to anyone. Downloading and installing widgets from the marketplace requires a valid licence.
- Marketplace widgets are currently provided at no additional charge. We may introduce paid widgets in future; if we do, the price and terms will be shown before any purchase.
- Widgets published in the marketplace include first party widgets made by us and third party widgets submitted by other users.
- Third party widgets are reviewed before publication, using a combination of automated checks and human review. The methods we use may change over time. Review is a good faith measure, not a guarantee. See Section 12.
- Each marketplace install shows you a permission review screen listing exactly what the widget can access, including the specific internet hosts it may contact. You may withhold individual permissions. Widgets bundled with the application are installed with the application; their permissions remain viewable in the marketplace and in the widget's manifest.
- Published widget versions are immutable: a released version is never replaced. Changes ship as new versions.
- We do not guarantee that the marketplace, any particular widget, or any particular version will remain available.
11. Publishing widgets
This section applies if you submit a widget to the marketplace.
11.1 Requirements
You need a purchased account and a publisher handle. We assign your widget's identifier as <handle>.<name> and stamp the author field ourselves. Handles that impersonate us or suggest official status are reserved and unavailable.
11.2 Your warranties
By submitting a widget you confirm that:
- you own it, or otherwise hold all rights necessary to submit it and to grant the licences in Section 11.3;
- it does not infringe anyone's intellectual property, privacy or other rights;
- it contains no malware, no deliberately obfuscated or minified code, no hidden functionality, and nothing that exceeds the permissions it declares;
- it complies with applicable law and with Section 13;
- any third party service it contacts is used in accordance with that service's own terms;
- any screenshots or other media you supply are yours to supply and contain no personal data of others.
11.3 The licences you grant
DeskDash widgets are public source. That is the model, and submitting means accepting it.
By submitting a widget, you grant, irrevocably and perpetually, on a worldwide, royalty free, non exclusive basis:
- to us, the right to host, reproduce, store, review, distribute, publicly display, and make available your widget and its associated media, in the marketplace, in the application, on our website, and in our promotional material, and to make technical modifications necessary for those purposes;
- to every user of DeskDash, the right to install, run, read, study, modify, and build upon your widget, and to publish derivative widgets in the marketplace.
These grants are irrevocable so that copies already installed, and derivative works already created, continue to function if you later remove your widget or delete your account. You retain ownership of your widget and remain free to license it elsewhere on any terms you like.
We may show attribution to you as the publisher. If you build on someone else's published widget, you must not misrepresent it as wholly your own work, and we encourage crediting the original.
11.4 No compensation
Publishing is unpaid. We owe you no fee, revenue share, or other compensation for a widget you submit, and submitting creates no employment, agency, or partnership relationship.
11.5 Review, rejection and staged media
We review every submission by hand and may reject it for any reason. Rejection is not a judgement on you or your work. Screenshots you upload become reachable at a public URL as soon as they are staged, which is before review, so do not upload anything you would not want seen.
11.6 Our removal right
We may remove, hide, or refuse any widget at any time, without notice and at our sole discretion. Reasons may include, without limitation: a legal complaint, a security concern, poor quality, similarity to something already in the catalogue, a poor fit for the store, or no reason at all. Removal from the marketplace does not affect copies already installed by users, and does not affect the licences granted in Section 11.3.
11.7 Account deletion and published widgets
Widgets you have already published, and their associated public listing information including your publisher handle as the author, remain in the marketplace after you delete your account, under the licences in Section 11.3. This is necessary so that installed copies keep working and derivative works stay lawful. Your account record and non public submission data are removed as described in our Privacy Policy.
12. Third party widgets: what our review does and does not mean
We review third party widgets before publication, and every widget runs inside a sandbox with a permission system that you control. Together these reduce risk substantially, and they are the reason DeskDash can have an open widget ecosystem at all. Neither, however, is offered as a guarantee.
12.1 Review is not a warranty
Review is a good faith measure to catch problems before publication. It examines code we did not write, and it cannot detect every possible issue. We do not warrant that any widget is free of defects, vulnerabilities, or malicious code, and a widget that passed review may nevertheless turn out to be harmful, unlawful, infringing, or to behave differently from how it presented itself.
12.2 Security measures and their limits
Security is a first order concern in how DeskDash is built, not an afterthought. Widgets run with no direct access to your network, filesystem, or operating system. Every capability is mediated by the application and gated by the permissions you approved, and that grant is re-applied every time a widget loads. Network access is limited to the exact hosts a widget declares, re-checked on every request and on every redirect. Credentials you supply are held by Windows and inserted into requests by the application itself, never made visible to widget code. We treat any weakness in these safeguards as a priority to fix.
As with all software, they are nevertheless provided without warranty. No security architecture can be guaranteed absolute, and we do not warrant that the sandbox, the permission system, or any other safeguard is free of defects or cannot be circumvented. If a widget escapes or exceeds the limits we intend to enforce, whether through a defect in DeskDash or by any other means, our responsibility is limited as set out in Section 12.3 and Section 17.
12.3 What you acknowledge
- A widget you install can do the things you granted it permission to do. Depending on what you approve, that may include contacting the internet hosts it declares, reading a file you have chosen, reading information about your desktop and system, controlling media playback or volume, or launching applications from a fixed catalogue.
- You decide what to grant at install time, and you can withhold any permission. Installing a widget, and choosing what to grant it, is your decision and is made at your own risk.
- Third party widgets are supplied by their publishers, not by us. We are not their author, we give no warranty in respect of them, and we are not a party to your use of them.
- We are not liable for the behaviour of a third party widget, whether that behaviour falls within the permissions you granted, exceeds them, or results from a defect in, or the circumvention of, our technical measures, except to the extent liability cannot be excluded under applicable law.
- We are not responsible for the accuracy, legality or availability of any third party service a widget contacts, or for any content a widget displays.
12.4 Reporting problems
If you believe a published widget is malicious, infringing, or otherwise improper, email contact@desktop-dashboard.com with the widget identifier and an explanation. If you believe you have found a security vulnerability in DeskDash itself, please report it to the same address and give us a reasonable opportunity to address it before disclosing it publicly. We will investigate reports we receive and may remove a widget under Section 11.6, but we do not commit to any particular response time or outcome.
13. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, or to store, transmit or distribute unlawful content;
- submit a widget containing malware, spyware, hidden functionality, or code designed to escape the sandbox, evade the permission system, or misrepresent what it does;
- attempt to gain unauthorised access to the Service or its underlying systems, or to circumvent licensing, rate limits, or other technical measures;
- share, resell, or publish licence keys, or attempt to use one licence across more devices than it permits;
- interfere with or disrupt the Service, or subject our APIs to abnormal or excessive load;
- impersonate us, another publisher, or any other person, including through your choice of handle, widget name, or listing content.
If we suspend or terminate your account for fraud, abuse, or a serious breach of this Section, you may forfeit fees already paid. This does not affect mandatory consumer rights.
14. Your own credentials and third party services
Some widgets work by connecting to a service where you hold the account, using credentials you supply. Where you do this:
- you are responsible for complying with that service's own terms;
- you are responsible for the credentials you supply and for any consequences of supplying them;
- we are not a party to your relationship with that service and are not responsible for it.
14.1 Risk to your accounts with those services
Many online services restrict automated access, data extraction, or access through unofficial or third party clients. A widget that reads from, displays data from, or otherwise interacts with such a service may cause you to breach that service's terms, even if you installed the widget in good faith and even if it passed our review.
Any consequence of that falls on you. It may include rate limiting, restriction, suspension or permanent termination of your account with that service, loss of data or purchases held in that account, and any other measure or claim the provider chooses to pursue.
Before you install a widget and supply credentials to it, it is your responsibility to satisfy yourself that its use of the relevant service is permitted. We do not review widgets for compliance with third party services' terms, we make no representation that any widget's use of any service is authorised by that service, and we accept no responsibility for the consequences to your accounts.
14.2 How your credentials are handled
Credentials you enter are stored on your own machine in Windows Credential Manager and are inserted into requests by the application itself, never exposed to widget code. This is described further in our Privacy Policy.
15. Updates
- The application checks for updates periodically and, on the direct download channel, may download an update in the background.
- We may install updates automatically where we consider it necessary, including without prior notice. This applies in particular to security fixes, defects causing data loss or instability, legal or compliance requirements, and changes needed to keep the application working with the services it depends on. For other updates, you choose when to install.
- Updates are cryptographically signed and verified before installation.
- We may stop supporting older versions, and may require an update as a condition of continued access to our online services. Running an outdated version may cause parts of the Service, including the marketplace, to stop working.
- If you obtain DeskDash through a third party store or platform, that platform's own terms also apply, and updates may be delivered by the platform instead of by us.
16. Availability and "as is"
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error free operation. The website, marketplace, licensing and update services may be unavailable for maintenance, updates, or reasons outside our control.
To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind except those that cannot be excluded under applicable law.
Your local data. The application stores your layouts, settings and widget data on your own computer. You are responsible for backing up your machine. To the extent permitted by law, we are not liable for loss or corruption of data stored on your device.
17. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential losses, or for loss of profits, revenue, data, or goodwill.
- Our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us for DeskDash in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or any mandatory consumer rights.
18. Consumer rights
If you use the Service as a consumer, you keep all mandatory rights granted to you under Romanian and EU consumer protection law, and nothing in these Terms removes or reduces those rights.
If you have a complaint, please contact us first at contact@desktop-dashboard.com so we can try to resolve it. As an EU consumer, you may also contact the Romanian consumer protection authority (Autoritatea Națională pentru Protecția Consumatorilor, ANPC, https://anpc.ro) or use an available alternative dispute resolution body. (The EU's online dispute resolution platform was discontinued in July 2025 and is no longer available.)
19. Suspension, termination and changes to these Terms
- By you. You may stop using the Service at any time and delete your account from your account settings.
- By us. We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the Service or other users. Where reasonable, we will give you notice and an opportunity to fix the issue.
- Effect of termination. Your right to use the marketplace and your account ends. Your rights under the EULA in respect of the version you have installed are addressed in the EULA. The licences you granted under Section 11.3 survive.
- Changes to these Terms. We may update these Terms. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email. Continued use after the changes take effect means you accept the updated Terms.
- Survival. Provisions that by their nature should continue after termination will survive, including Sections 11.3, 11.7, 12, 16, 17 and 21.
20. General
- Entire agreement. These Terms, together with the EULA and Privacy Policy, are the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the rest remains in force.
- No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
- Assignment. You may not assign your rights under these Terms. We may assign them as part of a merger, acquisition, or sale of assets, on notice to you.
21. Governing law and jurisdiction
These Terms are governed by the laws of Romania, and the courts of Romania have jurisdiction over any dispute, without prejudice to any mandatory consumer protection rights you may have in your country of residence within the EU.
22. Contact
For any question about these Terms, contact us at contact@desktop-dashboard.com.
